Where the regulation is going

In January 2025, the FDA revoked its authorization for FD&C Red No. 3 in foods and ingested drugs. The action was based on long-standing statutory requirements rather than new exposure data, and products containing Red 3 may still appear on shelves legally until the mandatory reformulation deadline of January 15, 2027.

In April 2025, HHS and the FDA announced a broader initiative to transition away from petroleum-based synthetic food dyes. Implementation timelines continue to evolve, but the direction is clear. California has passed legislation restricting synthetic dyes in K–12 school meals beginning December 31, 2027, and industry groups have announced voluntary commitments to remove FD&C colors from products served in schools.

Every Colorwayz product gets its color from real food ingredients β€” fruit, vegetables, and plant-based concentrates. No FD&C synthetic dyes are used in any of our cotton candy or cotton candy sugar.

Like cotton candy β€” sweet, light, spun from real fruit. We make each flavor to taste like the ingredient it's named after, not a stronger artificial version of it. If you've only had the bright-blue cotton candy from a county fair, ours will taste different. Closer to the fruit.

"Dye-free" specifically means no FD&C synthetic colors β€” Red 40, Yellow 5, Yellow 6, Blue 1, Blue 2, and Green 3. "Artificial-free" is a broader claim that can also include flavors, preservatives, or other additives. Colorwayz is dye-free across the full product line. We don't label Colorwayz as vegan. Commercial sugar is sometimes filtered through bone char during refining, and we don't have verified sourcing documentation to back a vegan claim. If that matters for your household, it's worth knowing.
